Terms of Service

These terms are a contract between you, the business using FlagHour, and Obied Ullah, who operates FlagHour (“FlagHour”, “we”, “us”). By creating an account or using FlagHour you agree to them, to the Privacy Policy and to the text message rules. If you don’t agree, don’t use FlagHour. Questions: help@flaghour.com.
These terms are also available in French. You chose to read and accept them in English.
1. Who can use FlagHour
- FlagHour is for businesses: independent mechanics, auto detailers and other mobile vehicle-service businesses, and repair shops. In these documents “mechanic” means any business that uses FlagHour. You must be of legal age where you live (18 or older, or the age of majority in your province or state) and use FlagHour for your business, not for personal, family or household purposes.
- If you accept these terms for a company, you confirm you’re allowed to bind it; “you” then means that company.
- Keep your password private and your account details accurate. You’re responsible for what happens in your account, including anything done by people you share it with. Tell us right away at help@flaghour.com if you think someone else got in.
2. What FlagHour does
FlagHour is software for mobile mechanics, detailers and similar vehicle-service businesses: scheduling, customer and vehicle records, job photos, estimates and invoices, text messages to your customers, card holds and payments through Stripe, a mileage log, and optional AI help to draft invoices. FlagHour is a tool. The repair work, your prices, your policies and your relationship with each customer are yours, and FlagHour is not responsible for them.
3. Your plan, billing and cancelling
- 14-day free trial, no card needed. It ends by itself; nothing is charged unless you subscribe.
- After that, FlagHour costs $19/month in the United States (US dollars) or C$25.99/month in Canada (Canadian dollars), or the price shown for your plan when you subscribe. Your subscription renews every month and is charged by Stripe to your card until you cancel.
- Your plan includes 400 customer texts a month. Optional boosts add texts and AI drafts: Boost $5.99 (C$7.99) and Boost Plus $12.99 (C$17.99) a month. Each text over your monthly allowance costs 3¢ US (4¢ CAD) and is added to your next bill. Settings → Billing shows how many texts you’ve used. The free trial includes 200 texts and 40 AI drafts in all; texts then stop until you subscribe (texts about a visit happening now still go out).
- Prices don’t include taxes. Where the law requires us to collect sales tax, GST/HST or QST, we add it to your bill.
- Cancel any time in Settings → Billing. Cancelling stops future charges; you keep full access until the end of the month you paid for. Payments already made aren’t refunded, except where the law requires it or we charged you by mistake. If you think we did, email help@flaghour.com and we’ll put it right.
- If a subscription payment fails, you keep full access for 7 days while you update your card; after that the account becomes view-only until you pay.
- We’ll email you at least 30 days before we raise your price. The new price applies from your next bill after that; you can cancel before then.
4. Payments from your customers
- Card holds and payments run on your own Stripe account, which you open with Stripe during setup. Stripe’s Connected Account Agreement and Services Agreement apply to that account. You are the seller in every transaction with your customers; FlagHour is not a party to it and never holds your money.
- FlagHour takes no cut of job payments, no-show fees or late-cancellation fees. You pay for the app through your subscription and any selected add-ons or messaging usage. You may record payments collected through Zelle, cash or check without charging the card. Stripe charges its own processing, refund and dispute fees for card transactions, which come out of your Stripe balance.
- Stripe decides when your balance is paid out to your bank and may pause payouts or payments on your account (for example, to verify your identity). We show what Stripe tells us, but we can’t override it.
- You choose your hold amount, no-show fee and cancellation window. You must be legally allowed to charge them, tell customers about them before they book (the hold page shows them before the customer enters a card), and only charge a fee or a bill the customer actually owes.
- Refunds, chargebacks and disputes are between you and your customer. You handle them in your Stripe dashboard and you’re responsible for any amount a customer’s bank takes back.
- FlagHour only charges a customer’s card when you tap to do so and confirm the amount. Holds that are never used drop off by themselves, usually after 7 days.
- You’re responsible for your prices, estimates, invoices, warranties and taxes, including collecting and paying any sales tax on your work.
Payment problems are not our responsibility
FlagHour is software that asks Stripe to place holds and take payments on your behalf; it does not guarantee that any customer will pay you. To the extent the law allows, we are not liable for: a card being declined, a hold failing, expiring or being released; a customer who doesn’t pay, cancels, no-shows or disputes a charge; chargebacks, refunds and their fees; amounts you entered or confirmed; Stripe holding, reversing, delaying or refusing payments or payouts, or closing your Stripe account; currency conversion; or texts and emails that don’t arrive. Any amount you are owed is owed by your customer, not by FlagHour.
5. Texting your customers
- FlagHour sends texts to your customers for you (through Twilio) about appointments, card holds, estimates, invoices, receipts, payment reminders, and, if you turn them on, review requests and service-due reminders. Every text names your business.
- Only add a customer’s mobile number if they gave it to you and agreed to receive texts about their appointment (see how customers agree to texts). You are responsible for having that consent and for following the laws on texting, including the U.S. Telephone Consumer Protection Act (TCPA) and Canada’s Anti-Spam Legislation (CASL), and the carriers’ rules.
- Don’t use FlagHour for marketing, promotions or messages a customer didn’t ask for, and don’t text a customer who asked you to stop.
- Customers can reply STOP (or ARRÊT) at any time; FlagHour then stops texting that number for every business on FlagHour until they reply START.
- We may limit how many texts an account sends to protect the shared phone number from being flagged as spam. Carriers can delay or block texts; we can’t guarantee every text arrives.
SMS terms for people who receive our texts
- Program: FlagHour appointment and payment notifications about your visit with the repair business you booked with. You receive them because you gave your mobile number for that appointment and agreed to texts from FlagHour.
- What you’ll receive: booking confirmations and card-hold links, appointment reminders, “on my way” and “arrived” updates, receipts and payment links, payment reminders, and an occasional review request or service-due reminder. No marketing.
- How often: varies, typically 3–8 messages per appointment. Message and data rates may apply.
- Stop or get help: reply STOP to stop receiving texts, START to resume, or HELP for help. You can also contact us at help@flaghour.com.
- Carriers are not liable for delayed or undelivered messages.
- Your mobile number and consent are never shared with third parties for marketing. See our Privacy Policy.
6. AI features
When you use “Describe the work” (spoken or typed), your words are sent to OpenAI to be turned into a draft invoice. FlagHour doesn’t keep voice recordings. AI can be wrong: the draft is only a suggestion, and you must check every line before you send it or charge a customer. You’re responsible for what you send.
7. Your data and your customers’ data
- Your business data is yours. You give us permission to store and process it only to run FlagHour for you, as described in the Privacy Policy. We don’t sell it.
- For your customers’ information, you are the business responsible for it and we handle it on your behalf. You must have the right to collect it, tell customers how you use it where the law requires, and answer their requests (we’ll help).
- You can download your jobs, invoices, customers and service records as CSV files any time in Settings.
- If you cancel, your data stays viewable (read-only) for 90 days, then the account is locked. We keep the data so you can come back, until you ask us to delete it.
- “Delete my account” in Settings closes the account at once (open card holds are released, open jobs cancelled, the subscription cancelled) and permanently deletes your data 90 days later. Your Stripe account is yours and isn’t affected.
- If we learn of a security incident affecting your data, we’ll tell you without undue delay and do what the law requires.
8. Acceptable use
Don’t use FlagHour for anything illegal or fraudulent, to charge people who don’t owe you money, to send spam or harassing messages, to upload content you don’t have the right to use, to try to access other accounts or our systems, or to copy, resell or reverse-engineer FlagHour. We may suspend or close an account that does, or that puts customers, other mechanics or the shared phone number at risk. We’ll tell you why, unless the law or safety stops us.
9. Our software
FlagHour, its code, design and name belong to us. We give you a personal, non-exclusive, non-transferable right to use it for your business while your account is in good standing. If you send us ideas or feedback, we may use them freely, with no obligation to you.
10. Availability and changes to FlagHour
We work hard to keep FlagHour running and your data safe, but it depends on other providers (Stripe, Twilio, Supabase, Google Cloud, Cloudflare, OpenAI and others) and on mobile signal, and it can have interruptions, delays or mistakes. We may improve, change or remove features. If we ever shut FlagHour down, we’ll give you at least 30 days’ notice, time to export your data, and a refund of any prepaid, unused period.
11. Disclaimer
To the extent the law allows, FlagHour is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that FlagHour will be uninterrupted or error-free, that every text or email will be delivered, or that it will prevent every no-show or unpaid bill.
12. Limit of liability
To the extent the law allows: we aren’t liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or business, even if we were told they were possible; and our total liability for all claims about FlagHour is limited to the greater of what you paid us in the 12 months before the claim and US$100. These limits don’t apply to liability that can’t be limited by law, such as for intentional or gross fault, or for bodily or moral injury.
13. Your responsibility to us
You agree to defend and compensate us (and pay reasonable legal costs) for claims by others arising from your work or services, your charges, refunds and disputes with your customers, texts sent to numbers without proper consent, content you upload, or your breach of these terms or the law.
14. Ending the agreement
You can stop at any time by cancelling or deleting your account. We may suspend or end your access if you seriously or repeatedly break these terms, don’t pay, or if the law requires it. Sections that by their nature should continue (payments owed, disclaimer, limits of liability, your responsibility to us, governing law) survive the end of the agreement.
15. Changes to these terms
If we change these terms in a way that matters, we’ll email you at least 30 days before the change takes effect and update the date at the top. Continuing to use FlagHour after that means you accept the new terms; if you don’t, you can cancel before they take effect.
16. Law, disputes and the rest
- These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Any dispute goes to the courts of the Province of Quebec, unless the law where you are gives you a right to another court. Either of us may use small-claims court.
- Please contact us first: most problems are solved faster by email. Where the law allows, claims are brought individually, not as part of a class or collective action.
- If part of these terms can’t be enforced, the rest still applies. Not enforcing a right right away doesn’t mean we give it up. You can’t transfer this agreement without our consent; we may transfer it to whoever takes over FlagHour, and we’ll tell you.
- Neither of us is responsible for delays caused by events beyond reasonable control (such as outages of providers, carriers or the internet, natural disasters or government action).
- These terms, the Privacy Policy and the text message rules are the whole agreement between us about FlagHour. We send notices to your account email; you can reach us at help@flaghour.com.
